Terms of Service

These Terms of Service ("Terms") govern your purchase of products from NOWA Technologies Pte. Ltd. ("NOWA," "we," "us," or "our") through our website and Shopify checkout (the "Site"). By placing an order, you agree to these Terms. Please read them carefully.
1. Acceptance of terms & eligibility
By using the Site or placing an order, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and are legally able to enter into a binding contract. NOWA devices are children's products intended for use by children ages 3–10 under adult supervision. You are purchasing as the adult account holder and parent/guardian responsible for the child's use of the device — see Section 5 below.
If you do not meet these requirements, please do not place an order.
2. Products & pricing
The current price of NOWA is shown on the product page and at checkout, and includes your NOWA device and applicable import/clearance costs. Shipping is not included in the device price: the shipping cost charged at checkout is an estimate based on current carrier rates, and — because your order is a pre-order — actual shipping costs may change before your order ships. If they do, we will contact you by email before shipping, and you may choose to pay the difference or cancel your order for a full refund of everything you've paid (see our Shipping Policy). Any sales tax is added at checkout where applicable, based on your shipping address. All prices are shown in USD and are subject to change without notice; the price you are charged is the price displayed at the time you complete checkout. We reserve the right to cancel and refund any order affected by a pricing or listing error.
3. Pre-order Terms
NOWA is currently sold as a pre-order. This section applies in addition to Sections 1–2 and 4–10.
3.1 What a pre-order means
By placing a pre-order, you reserve a NOWA unit from our first production run. Your payment method is charged in full at checkout, at the time you place your order — this is not a deposit and no further charge is made later.
3.2 Estimated shipping window
Pre-orders are expected to ship on or before November 30, 2026. This date is based on our current production schedule. If our shipping timeline shifts materially, we will notify you by email.
3.3 Right to cancel if we're delayed
If we are unable to ship your order within the estimated window (or any revised window we've communicated to you), you have the right to either continue waiting or cancel your order for a full refund of the amount you paid.
3.4 Cancel before shipment
You may cancel your pre-order at any time before it ships for a full refund. See our Return & Refund Policy for how to request a cancellation and refund timelines.
3.5 Order updates & tracking
We will email you at key milestones as your pre-order progresses, and send tracking information once your order ships.
3b. One-time purchase & included subscription
Your NOWA purchase is a single, one-time charge. Your card will not be charged again automatically as part of this purchase.
Your pre-order includes one (1) year of NOWA's subscription content service at no additional cost. After the included year ends, continuing the subscription is optional and we will not charge you automatically. Details of the subscription service and any renewal terms will be presented to you before you make any additional payment. Any optional in-app purchases are governed by separate terms presented at the time of purchase.
4. Returns & refunds
Cancellations, returns, refunds, and related timelines are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Please refer to that policy for details — we do not duplicate them here.
5. Device & account
5.1 Parent/guardian account
To purchase and set up NOWA, you create a parent/guardian account (via email/password or a supported login provider) and pair your NOWA device to that account. Children do not create their own accounts.
5.2 Intended use
NOWA is designed for children ages 3–10 and is intended to be used under the supervision of a parent or guardian. You are responsible for setting up and supervising your child's use of the device in accordance with the included safety booklet and any in-app guidance.
5.3 Appropriate use
You agree to use the Site, your account, and your NOWA device only for their intended personal, non-commercial purposes, and not to misuse, resell without authorization, or tamper with the device's software or hardware in a way that compromises safety.
6. Warranty
NOWA devices are covered by a 12-month limited warranty against defects in materials and workmanship under normal use, starting from the date of delivery. This warranty does not cover damage from misuse, unauthorized modification, accidents, or normal wear and tear. See our Return & Refund Policy for how to request warranty service.
EXCEPT AS EXPRESSLY STATED IN THIS SECTION, THE PRODUCTS AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NOWA TECHNOLOGIES PTE. LTD. AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR YOUR NOWA DEVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
8. Governing law & dispute resolution
These Terms are governed by the laws of the Republic of Singapore, without regard to conflict-of-law principles. Nothing in these Terms limits any rights you have under applicable U.S. federal or state consumer protection laws. Any dispute arising out of or relating to these Terms or your purchase will be resolved by final and binding arbitration administered by the Singapore International Arbitration Centre (SIAC), seated in Singapore and conducted in English.
9. Changes to these terms
We may update these Terms from time to time, including to reflect changes in our products, services, or legal requirements. If we make material changes, we will update the "Last updated" date above and, where required by law, provide additional notice. Your continued use of the Site or a subsequent order after changes take effect constitutes your acceptance of the updated Terms.
